The Camping ban, the City of Fremont was called to repeal this. Did they? No. They just removed the Aiding and Abetting content in the ban.
This however, cannot be removed due to being in the Municipal and State code already.
Aiding and abetting is a legal doctrine related to the guilt of someone who aids or abets (encourages, incites) another person in the commission of a crime (or in another’s suicide). It exists in a number of different countries and generally allows a court to pronounce someone guilty for aiding and abetting in a crime even if he or she is not the principal offender. The words aiding, abetting and accessory are closely used but have differences. While aiding means providing support or assistance to someone, abetting means encouraging someone else to commit a crime. Accessory is someone who in fact assists “commission of a crime committed primarily by someone else”.
In this case it’s used to help someone like providing a meal, a tent, shelter, and the like. Now, it’s illegal to be unhoused. One could be charged with a $1,000. fine and six months in jail. The above paragraph would be true as we would become criminals.
It was like they have a choice repeal the ban or get sued.. I guess since they hired expensive lawyers, they would be better to get sued. Costing the taxpayers a lot of money. Why not use the city lawyer in this case?
It was all a PR stunt.
The real issue is that the city hasn’t built enough housing for seniors or those with a fixed income. Of course Salwan the mayor keeps saying the city doesn’t build housing. Really? Your job is to make sure there is housing being built.
There are over 1,000 people unhoused. Does he care? Nope. Not from my end anyway.
As a landlord, a developer he just wants to serve his buddies in building premium or higher market rate housing, for the tech guys. If you aren’t working for a tech guy you are not welcome in Fremont. As Fremont is not for everyone. Thus let’s create the camping ban!!

There is a group I am a member of “Fremont for Everyone,” you can find all the information you want to read about this situation. The legal docs, why it’s inhumane and cruel. The camping ban, does not work and will not work. It’s superfluous.

We are in a housing crisis, blaming people because they can’t afford paying out 80% of their income or more on housing is wrong!
